NEW YORK (AP) — All nine people injured during a dramatic confrontation between police and a gunman outside the Empire State Building were wounded by gunfire from the two officers, police said Saturday, citing ballistics evidence.
The veteran patrolmen who opened fire on the suit-clad gunman, Jeffrey Johnson, had only an instant to react when he whirled around and pointed a .45-caliber pistol at them as they approached him from behind on a busy sidewalk.
Officer Craig Matthews shot seven times, and Officer Robert Sinishtaj fired nine times, police said. Neither had ever fired their weapons before on a patrol.
The volley of gunfire felled Johnson in just a few seconds and left nine other people bleeding on the sidewalk.

CHESTERFIELD, VA— The Rutherford Institute has come to the defense of a former Marine, 26-year-old Brandon Raub, who was arrested, detained indefinitely in a psych ward and forced to undergo psychological evaluations based solely on the controversial nature of lines from song lyrics, political messages and virtual card games which he posted to his private Facebook page. Although the FBI and Chesterfield County police have not charged Brandon Raub, a resident of Chesterfield County, Va., with committing any crime, they arrested Raub on Thursday, August 16, 2012, and transported him to John Randolph Medical Center, where he was held against his will due to alleged concerns that his Facebook (FB) posts were controversial and "terrorist in nature." In a hearing held at the hospital, government officials disregarded Raub's explanation that the Facebook posts were being interpreted out of context, sentencing him up to 30 days' further confinement in a VA psych ward. In coming to Raub's defense, Rutherford Institute attorneys are challenging Raub's arrest and forcible detention, as well as the government's overt Facebook surveillance and violation of Raub's First Amendment rights.

ROMNEY LOSES CAMPAIGN SONG, GAINS CLASSIC ROCKER ENDORSEMENT,

Yesterday, we learned Mitt Romney can no longer use the Silversun Pickups' track "Panic Switch" on the campaign trail. It's hardly the first time a liberal music act put its foot down to prevent a GOP type from playing a particular song during election season.
But Romney's campaign might now have access to "Sweet Home Alabama," "Free Bird" or other Lynyrd Skynyrd classic cuts.

President Barack Obama could lose his home state of Illinois in November, a new poll shows.
A poll conducted by Illinois-based pollster and political strategist Michael McKeon found Obama leading Republican Mitt Romney by 49 percent to 37 percent in Cook County, the home of Chicago. That puts him ahead by a far thinner margin than expected in a county he should be winning handsomely.

NYPD Probing Hate Crime After Bacon Found At Staten Island Ramadan Site

Police are investigating an unusual bias crime on Staten Island.
Muslims who gathered for prayer to celebrate the end of Ramadan in a city park found bacon scattered on the ground, CBS 2’s John Slattery reported Monday.
With Ramadan ending this past weekend, Muslims celebrated the end of fasting with prayer. On Staten Island an outdoor service was held Sunday on a New Dorp football field, attracting some 1,500 Muslims.
But before most of the faithful arrived for Morning Prayer, it was discovered that someone had scattered a quantity of raw bacon on the field.
“This has been determined to be a bias event on the part of our Hate Crimes Task Force,” NYPD Commissioner Ray Kelly told reporters, including WCBS 880′s Rich Lamb.
“On a website associated with this celebration was some derogatory comments and at the site itself, three packages of raw bacon were found,” Kelly added.
